Giving Miranda “Rights” to Terrorists- [Strong Dems Talking Points]

RESPONSE:

The Constitution is the Drivers Manual for the Government of the United States.

It doesn’t GIVE rights or freedoms TO people, it RESTRICTS Government from taking AWAY the natural rights and creator-given freedoms you already have.

They are actually called the “Miranda Warnings.”

FOLLOW-UP:

All people have certain inalienable rights, and the Constitution and our laws exist to limit the Government from being tyrannical. The (Police, FBI, etc.) have to follow the rules, no matter how big a scum-bag the accused may be.

Your rights and freedoms end the second you cross the border.  It means that our Constitution was designed by the founders to make sure that all people were protected as far as how our Government operates.

We can’t control how other counties handle the natural freedoms and rights people already have, but we can restrict our own Government from taking those natural freedoms and rights away.

UNCOVERS:

Calling something a “war” should never be used to subvert the Constitution. We have a “war” on obesity, but we are not setting up a stake-out at McDonald’s to prevent Joe Citizen from getting a Big Mac.

Similarly, the “right to free speech” only applies to Government taking away that right. It doesn’t prevent your employer from firing you if you scream obscenities at your boss.

SIDE POINTS:

These are rules for Law Enforcement to follow defined by the “drivers manual”, not rights given to a suspect defined by the accuser.

  • The Constitution is a manual defining how far the power of Government can go.
  • Rights are not given to anyone.  Simply, it prevents the intrusion of Government from taking away your natural rights.
  • Strict Constitutionalists and Libertarians should respect this concept.
  • It also applies to Christians, Jews, Muslims, Buddhists, Wickens, Atheists, Pastafarians, Anarchists, and all others.
  • Freedom is cool.

On the Miranda warning (Wiki):
The Miranda warning is a warning given by police in the United States to criminal suspects in police custody, or in a custodial situation, before they are interrogated.  A custodial situation is one in which the suspect’s freedom of movement is restrained (judged by the “free to leave” test), even if he is not under arrest.  An elicited incriminating statement by a suspect will NOT constitute admissible evidence unless the suspect was informed of his/her “Miranda rights” and made a knowing, intelligent, and voluntary waiver of those rights.

Thinking the Government Can Solve All Problems- [StrongDems]

RESPONSE:

Who do you think ‘The Government’ is?  It’s YOU!

‘We The People’ have the responsibility to protect the powerless against the abuses of the powerful.

FOLLOW-UP:

Can you, John Q. Public, fight Goldman Sacks?  Can you build your own tunnel?  Can you cap credit card rates so they don’t go up to 30-40%.  Can you stop a power plant from polluting?  Can you protect food from having diseases?  Can you make Insurance companies cover pre-existing conditions?

Not ALL problems should be solved by Government, just the ones that are controlled by multi-millionaires, and protected by high-priced Corporate Lawyers, out to make a buck on the backs of the middle-class.

When you have a system that gives more power to the wealthy, the odds are stacked against the favor of working families.

‘We The People’ make the rules of the game for Corporations in this country, not the other way around.

UNCOVERS:

Democrats are for the working-class, and Republicans are for the powerful elite.

The often repeated ‘bigger Government’, or ‘more Government’, makes it sound like the bigger Government is, the worse it is.  The fact is, the bigger Government gets, the more it indicates how BAD the problems facing the powerless are.

Government should be as large as it needs to be in order to do the job our founders created it to do.

Average Americans don’t have millions of dollars of their own to pay for lawyers; they don’t have the power to make the rules of the game that these Corporations play by.

Government is us, and only the collective power of an active democracy can insure the safety and security of all Americans.

SIDE POINTS:

Distrust of Government really began it’s overdrive campaign after Reagan famously said, “The nine most terrifying words in the English language are, ‘I’m from the government and I’m here to help.’

Giving Rights to Terrorists- [StrongDems]

Response (religion frame):

Only God can take away a person’s rights without a trial, not the Republican party.  Human rights come from Nature, not some political game for the cameras.


Response (law frame):

Does X think that, with a stroke of a pen in Washington, Government can take away anyone’s right to blink?  The Constitution was made to limit Government power, not the other way around, X.  I suggest you read it again.


Response (other):

This isn’t about Terrorists, and it isn’t about Rights, and X knows it.  It’s about Government power.  This is about making sure Government Bureaucrats can’t take yours freedoms away.


Follow-up:

Not only are you changing 212 years of American Constitutional Tradition, but you are immorally taking away the “rights of man” (use air quotes) by the stroke of a pen in Washington.  Do you really want us to be more like Tehran?  As we have learned, a Government bureaucrat on a witch hunt can do a lot of harm.  Is McCarthyism now the policy of the Republican party??

Side Points:

The Constitution limits the ability for our Government to take AWAY rights from all people.

Our founders (like Jefferson and Madison) created our Constitution to make sure that every dictator, king, or tyrannical despot know… ALL People (our Constitution never says ‘Citizens’) naturally have certain inalienable rights above Government, and shall not be infringed.
